UPDATES- Dems believe WI GOP vote was illegal

As Paddy posted earlier, Wisconsin GOP passed their budget bill without the Democrats present. The 14 Democrats are still out of state.

Democrats are saying they believe under Rule 3 under legislature the GOP vote was illegal. They are saying they’ll have a media event within the hour.

There’s always the possibility of a general strike, says Ed Schultz on MSNBC as we speak.

UPDATE:

Assembly Minority Leader Peter Barca, D-Kenosha, denounced tonight’s actions as illegal and said he planned to contact the attorney general to request an investigation.

“It is a continuation of a pattern of a naked abuse of power,” Barca said.

Via an email I just got:

Since they included the pay and benefit cuts, isn’t this is a fiscal bill?

SECTION 8.  On the passage in either house of the legislature of any law which imposes, continues or renews a tax, or creates a debt or charge, or makes, continues or renews an appropriation of public or trust money, or releases, discharges or commutes a claim or demand of the state, the question shall be taken by yeas and nays, which shall be duly entered on the journal; and three−fifths of all the members elected to such house shall in all such cases be required to constitute a quorum therein

UPDATE, via MSNBC: Dems know the GOP wanted them to come back, so debated coming back as all this was going on. Some members’ resolve was cracking re: denying the quorum. But they didn’t need the 1 or 2 Dems after all, now did they?

One Dem Senator’s (sorry, missed the name) statement (Slightly paraphrased): In 30 minutes, 18 State Senators undid 50 years of civil rights. .. conspired to take government away from the people. Tomorrow, we will help the people take back their government.

Lawrence O’Donnell: They sound like they know they lost.

Walker applauds move

Rep. Peter Barca said they were completely caught off guard, that this broke the law. “Unless there’s good cause, you need one hour’s notice.” They did not get that. No question that this was a violation of the open meetings law. The fraud on WI was there for everyone to see. This was not a fiscal bill. The fraud has been exposed. It’s now clear to every person in WI how far they will go… I don’t recognize WI any more. This governor has divided this state…”

Barca is saying that he’ll talk to Miller about whether he’ll return tomorrow.

Mason: One remedy is to be forced to take the action again in the light of day.

Here’s a link to the LFB memo on the bill:

Here’s the roll call.

Via email alert:

MADISON, Wis. (AP) Democratic leader of Wisconsin Senate says AWOL lawmakers will return to the state on Thursday

UPDATE: Liveblogging Dem Sen. Chris Larson on The Last Word: “If they wanted us back, they could have had us back. We’re getting together to see what legal action can be taken. They’ve been sloppy in their haste trying to get this done. But the story is where the Republicans are…[not with] the people. They’ve proved themselves to be deceptive. Special interests over people. Shutting down public debate, public hearings, the phone lines, the capitol, our offices, and now this. There’s no low they won’t go to to kill workers’ rights. Untrustworthy, can’t keep their word. We asked for negotiations. They used the letter as a prop in a press conference… shows where they are, where they’re at. They’re passing things w/o the public being aware of them. I doubt if many in WI have heard what happened. A lot of people will step out to the streets to recall…

Via one of my WI contacts:

I’m inside. Came in through a window. Leaks everywhere. Cops trying to keep it tight. I was shoved by one while filming protesters coming through a bathroom window. Chanting “general strike” in rotunda.

Comparison of the LFB memos: a quick summary of the differences between the version approved by the Senate this evening and the bill that came out of the Joint Finance Committee, according to the LFB memos describing each bill.

UPDATE: Via @news3jessica: UPDATE FROM SEN. MILLER’S OFFICE: Senators will not be coming back tonight or tomorrow.

Miller says time for Dems to come home and take fight to ballot box

One day short of the three-week anniversary of their departure, Senate Minority Leader Mark Miller said it’s time for Dems to come home and take the fight over collective bargaining rights to the ballot box. [...]

“We’re trying to figure out whether we should change it to Czar Walker. I think that’s the term. The Senate should be called the Evil Empire.

UPDATE: Watching Rachel Maddow as we speak. Sen. Erpenbach is on with her now. “What they did is violate law. This will probably end up in court…. If we don’t, someone will take [this] to court. As it stands right now, we’re staying out of the state … we don’t trust the GOP, Walker. The entire state of WI is ashamed of them. We won’t go back because of the games they could play. There is unanimity on this, yes.”

Is Voting now banned in Reedsburg,  Wisconsin?

“Feeding at the union trough”? Oh yes, that’s right, THEY don’t pay taxes right? THEY don’t work for a living, right [did you NOT notice the police and firefighters were on the side of the PUBLIC WORKERS, not the side of Czar Walker?]? THEY are getting rich off of YOU, making $50K/yr after teaching for 25 yrs – WHAT NERVE they have!

Meanwhile, The Koch brothers, multi-billionaires who INHERITED IT – DID NOT EARN IT, nor are they “entitled” to TAKE MORE OF IT, got huge tax breaks that YOU and all those horrible union workers will have to make up for…. but that’s fine with you? REALLY? If that’s the case you deserve to make minimum wage & have no benefits – just what you want for others….or you COULD stop trying to drag everyone else down with you. It’s also possible you are one of the top 5%….or even a Koch employee/friend/family; who knows……one can say anything they want online using anonymity – ain’t it great?!

The R’s passed a law ILLEGALLY and it’s somehow the Dems fault becuz the only way they could try to stop this fiasco was to deprive R’s of a quorum, which MOST #WIsconsin WORKERS WERE FOR, not against………yep, another good little Republican buying into the lie that the Rich want YOU to have the American dream even while THEY do their damnedest to stop you AND EVERYONE ELSE who isn’t already a part of their inner circle from ever having it…….

Only FOOLS believe that Teachers are bad but the Koch brothers and their Repub pals passing laws illegally are patriotic.

Thing is the JUDGE in Wisconsin seems to disagree w/ YOU…..say’s the Dems are right; the law can not be enforced becuz they did it ILLEGALLY……I think it likely that a Judge knows far more than you do about the laws in WI.

Your irrational hatred of union workers is being used to bring DOWN, not only their pay and benefits, but those in the private sector too- maybe even your own ……common sense tells us a corporation will never pay you more than they HAVE TO…..bcuz they’re ONLY goal is profit; get it? They don’t care about YOU or ANY worker under CEO status…….you’re just a number to them.

So maybe you should be helping those folks working union jobs [Teachers, Police, Fire, secretaries. etc] bring EVERYONE’S pay/benefits UP instead of helping the richest corporations [Bank CEO's, Pharma, oil lords, and the politicians they buy off] continue to steal from and /or screw EVERYONE – YOU INCLUDED [unless you are one of the elitists just listed]

But so long as they can get you to believe they have somehow been mistreated [I mean they ONLY made billions in profits, not trillions! such a shame!]…….they will continue to laugh ……..all the way to the bank!

Try HELPING your state AND it’s people, instead of helping destroy it, omg :(

This has nothing to do with fiscal responsibility. First, the governor gave $171 million in tax cuts to business in the first 4 policies he passed. If they needed money why give it away? Second, unions were willing to sacrifice pension, insurance, etc. all for the governor but not bargaining rights. The governor rejected this. If saving money was the reason why reject this? There is no correlation AT ALL that states with collective bargaining rights are having fiscal issues now or going to in the future. Why do this if there is no current or future reason for this policy change? The WI states equivalent to the CBO stated that there is NO FISCAL EMERGENCY and that the budget was going to run a surplus, that is until he gave the tax cuts away. Why go forward with this when there is no fiscal emergency?

There is one very simple and logical reason for this. This isn’t about a budget issue. It is an all to common political tactic. Just as leaving to deny quorum is. Hell Abraham Lincoln jumped out of the second story of the capital building to deny quorum. BTW he was a Republican of integrity in case you needed a point of reference.

What name calling? Fact: the senate Dems left the state, AWOL for two-weeks. They couldn’t get their way so ran away and hid. I have a 7 year old that’s more mature and responnsible than those senate Dems. You can’t have a functioning representative government when representatives choose to participate only when their position is the majority. Our state is in financial crisis and it can’t always be the other guy that has to take the hit.

  • raymond biasotti

lots of name-calling, how about some facts?

  • Mm543

The majority of Wisconsin citizens, those not feeding at the Union trough, should thank God they have a governor and majority in the state legislature with coconuts big enough to do what’s necessary to save their state from econimic collaspe. And those Dems who fled to Illinois perhaps should stay away. Their failure to stay and negotiate a compromise clearly indicates they’re fools who failed their mandate as representatives of the people.

You really need to stop drinking while you’re on your anti-psychotic medication. Jesus Christ! Hitler & the Bundestag….. you couldn’t go the way of, say, Naomi Klein and her ‘The Shock Doctrine’ – had to drag the fucking Nazis into this. Try the fascists; that’s what this is – fascism.

    Not everyone is asleep.

  • Emily Peacock

There will be a general strike and there will be a recall of every senator who can be recalled. Walker should be charged with ethics violations or tarred and feathered and run out of town on a rail. Either way works.

  • MitchM

Some of us have bee talking Nazis and Hitler and fire in the Bundestag (think Shock and Awe) since Bush was elected.

    Believe us now?

And the spineless dims have been the facilitators, because very time a rich donor stared at them real hard they lay down and whimpered.

Walker didn’t do this all by himself this is a national take over.

Give it 6 months as other states do the same types of take overs and the US will be a 1 party minority controlled country.
