Judge tosses Liberty University’s challenge to Obama healthcare law

One down.

A federal judge in Virginia dismissed one of many lawsuits against President Obama’s  health care law:

The challenge, one of several attempting to strike down the law passed earlier this year, was brought by the conservative Christian Liberty University and individuals who said the law would violate several parts of the U.S. Constitution.  [...]

Moon found that without the coverage requirements in the law, the cost of health insurance would increase because the number of insured individuals would decline, “precisely the harms that Congress sought to address with the Act’s regulatory measures.”

Further, interstate commerce would be hurt by large employers failing to offer adequate healthcare coverage, thus “the employer coverage provision is a lawful exercise of Congress’ Commerce Clause power,” said Moon, who was appointed by then-Democratic President Bill Clinton.

I knew that, and I’m not even a judge.

After Judge Moon’s ruling, I guess they might have an inkling that they’ve failed to convert the entire nation.

If you weren’t already aware, Liberty University was founded by Jerry Falwell; their lawyer said they’d appeal. Anything to get rid of Obama and sprouts of decent health care reform that could actually help people.

Suspect in sex assault case got pardoned by Tim Pawlenty in 2008

Let me put it this way:

Cleared by a panel that included Gov. Tim Pawlenty, Jeremy Giefer is now accused of assaulting a second girl hundreds of times before and after he received his pardon.

I smell a problem in 2012, Tim:

Two years ago, Gov. Tim Pawlenty and two other officials pardoned Jeremy Giefer, who had served a short time in jail in the 1990s as a young man for having sex with a 14-year-old girlfriend whom he later married.

Blue Earth County prosecutors now say Giefer was sexually assaulting another young girl hundreds of times before and after he received his pardon.

The criminal charges filed against Giefer this month have drawn attention to the earlier pardon as Pawlenty weighs a possible run for president.

“‘Countdown with Keith Olbermann’ was the only 8pm cable news show to increase year to year”

Some good news for Keith Olbermann, and of course, us:

Parker / Spitzer was down 28% in the cable news target adults 25-54 demo, and down 35% in average viewership compared to Campbell Brown’s November last year.

Nancy Grace’s 25-54 demo declines (-33%) at 8pm were even worse vs. last November than Parker/Spitzer’s. The O’Reilly Factor also showed declines, while Countdown with Keith Olbermann was the only 8pm cable news show to increase year to year.

Michigan Democratic Candidate Lance Enderle’s Open Letter to President Obama, DCCC & DNC

Michigan Democratic candidate Lance Enderle– or rather, former and future candidate– and I have become friends while working together on his campaign. I am determined to keep him in the spotlight, get him some name recognition and on-air time, so that when he runs again, he’ll beat the pants of any member of the GOP.

He wrote a little something for Down With Tyranny. I’ll give you some excerpts, then please read the whole thing here:

Dear Mr. President, DCCC, and DNC,

I hope by the 2012 election that you are ready to fight and take this country back and help move us forward, instead of letting it shift farther backwards and into a fascist run state where corporations have more say than the people of this country. I am asking this as a foot soldier in the cause– I was a Congressional candidate. I am telling you this because you didn’t know I was on the ballot. Maybe that is a reason why we lost. Do you not even know who all of your candidates are? If you are asking how to do I know this, the answer is simple–the DNC and DCCC had the other guy’s name who I replaced on the ballot on their website as did a few major media outlets (Washington Post and New York Times) days before the election. So if they couldn’t even care about helping a Democrat get proper listing in informational outlets, why would they care if they could win the seat or not? Do you have any answers? I do, especially if you want to win in 2012!

First, you need to address ALL of your candidates, not just a select few! Second, quit worrying about the money and get out on the streets with the people, the money will come! Next, learn how to communicate like you once did, speak to the people not at them. GET BACK TO BASICS!

Lastly, quit compromising with those who chose to not negotiate and spew lies and hate. [Editor Note: Link added]

Before this Congress concludes, please shove some legislation down their proverbial throats in the next month. You have the bills passed in House, and you both still have control for the next month. “…And About those Tax Cuts”: A piece of satire by Steve Weinstein

One of my absolute favorite Twitter friends has offered to share something he wrote with TPC.  Steve Weinstein is a talented and accomplished writer who has come up with a piece of satire about “President Obama yet again negotiating uselessly with himself.”

In this episode, Prez O’s premature offering of the federal employee pay freeze to the GOP gets the Weinstein treatment:

A Democrat walks into a GOP car dealership. “I really like this model,” the Dem announces. “What kind of deal can you offer me today?”

“Well the MSRP is $44,995,” replies the salesman, “and I absolutely cannot take a penny less.”

“Hmmm,” sighs the Dem. “I was hoping for some kind of compromise because this is going to blow a giant hole in my budget. What if I throw in the vehicle that I’m currently driving? It’s served me well for years and years.”

“I love your vehicle,” says the salesman. “Everyone had such hope for that model. Especially back in 2008. I’ll take it, but I’m still going to have to insist on the full MSRP for the new car.”

Dumbfounded, the Dem stares at the salesman for a second and marvels, “Wow, that really doesn’t seem fair.”

“Hold on,” says the salesman, “Let me see what I can do.” He disappears into a back office. When he returns ten minutes later he enthusiastically proclaims, “I just made a call to my manager at the Chamber of Commerce, and he has authorized me to accept your used vehicle AND the full MSRP in exchange for the new one. But as a gesture of goodwill for our taking this shopworn issue off the road for good, he insists that you also leave us your backbone and everything you have ever believed in in the trunk of your old car.”

The Dem ponders the offer for a second, then turns to walk away. Two steps later, he spins around and stuns even the salesman. “OK. If that’s the only way I’m going to get out of here today, you’ve got yourself a deal.”

The salesman smiles and hands over the keys to the shiny new automobile. “There’s just one more thing.”

“What’s that?” the Dem asks.

“I’m going to have to line up a gauntlet of the entire sales and service crews and allow them to fling raw eggs at your new car as you drive it off the lot.”

“That doesn’t sound too bad,” the Dem agrees. “As long as they don’t shriek, ‘Socialist’ or  ‘Antichrist’ as they do.

“Terrific,” the salesman concludes with a smirk. “But do remember that in a free country, I can’t make any promises.”

Wikileaks may have uncovered something of a bombshell:

The British government promised to protect America’s interests during the Chilcot inquiry into the Iraq war, according to a secret cable sent from the US embassy in London.

Jon Day, the Ministry of Defence’s director general for security policy, told US under-secretary of state Ellen Tauscher that the UK had “put measures in place to protect your interests during the UK inquiry into the causes of the Iraq war”. [...]

Andrew Burgin, a spokesman for the Stop the War Coalition, was reported as saying: “This shows is the beginning of the cover-up”.

This really brings the whole inquiry into disrepute,” he said. “Those involved in this cover-up must be held to account. The implications are so serious that there may need to be a new inquiry.”

One day, some how, some way, enough documented truth about BushCo’s fraudulent war will be exposed, which might finally lead to legal action. I am not ready to give up on that notion.

Re “Law grad’s legal quandary,” Column, Nov. 26

Hector Tobar provides a compelling reason why we should support the DREAM Act. Unfortunately, Tobar’s eloquence will prove futile.

The “tea partyers” and Fox News have cast a toxic cloud over the subject. Their 24/7 barrage of hate, fear and fiction has prevented an intelligent discussion on the DREAM Act.

These folks love the Luis Perezes of the world, provided they wash our cars, cut our grass and be nannies to our children.

But God forbid they should become educated; that indeed would create an unacceptable challenge.
